ACCESS TO STUDENT INFORMATION (COURT ORDER COMPLIANCE) 5170

POLICY:
Student information shall be furnished in compliance with court orders or a lawfully issued subpoena. If lawfully possible within the requirements of the judicial order, the College shall make a reasonable effort to notify students in advance of such compliance.

ACCESS TO STUDENT INFORMATION (COURT ORDER COMPLIANCE) 5170


I. COURT ORDERS AND LAWFULLY ISSUED SUBPOENAS

All inquiries are entered into a log. Subpoenas are either personally delivered or mailed. The fee for processing a subpoena is $15.00, which is collected with the request. All subpoenas must be signed by a judge or the clerk of the court. If they do not have the appropriate signature, they are returned to the sender with a letter of explanation. We use the following guidelines to process all subpoenas:

1. Send the student a notice informing him/her that their records have been subpoenaed.

2. Allow five (5) days for the student to respond to the notification before complying with the subpoena when possible.

3. Copy all documents requested and send to the requesting party. We file the subpoena in alphabetical order by month. These requests are considered permanent record items and are kept in the student’s folder, or optically scanned.
